Lavender and Lace Photography Services Terms and Conditions


TERMS AND CONDITIONS


This photography services agreement outlines the complete understanding between the client and the photographer. Any modifications to this client photographer contract will only be effective if confirmed in writing by both parties.


1. Special Requests/Coverage. The client acknowledges that the photographer will determine the photographic coverage based on professional expertise, and no single photograph will be prioritized over another. While special requests are welcomed, they are not binding instructions; therefore, any additional requests not mentioned in this booking form must be communicated in writing.


2. The Photographer. Occasionally, due to health issues or unforeseen circumstances, it may be necessary to substitute the chosen photographer with an alternative. We will endeavor to keep you informed of any changes, but due to the nature of events, rapid sourcing of a replacement may not always be feasible. If we are unable to reach you before the event, we reserve the right to provide a replacement photographer of equal or superior quality to the original.


3. Images. All image sizes are approximate. The photographer will strive to achieve a pleasing color balance but cannot guarantee precise color matching due to variances caused by certain materials, especially synthetic fibers. Capturing the exact color perceived by the human eye can sometimes be challenging.


4. Retouching. Retouching, digital manipulation, and artistic finishing are included in the service. Additional retouching can be provided as an optional extra for the client.


5. Copyright. Images, whether digitally stored or otherwise, are protected under the Copyright and Design Act 1988. It is prohibited to copy or allow the copying of any image created under this contract without written consent from the photographer. Breaking the seals in the viewing album will imply a breach of copyright, and editing or adding filters to digital images is not allowed.


6. Reorders. All reorders will be treated as extensions of this photography services agreement, and we will not accept responsibility for errors unless orders are confirmed in writing.


7. Negatives/Digital Files. Negatives and digital files remain the property of the photographer.


8. License. The photographer is granted complete artistic license regarding poses and locations used. The photographer’s decisions on locations, poses, and the number of images captured are final.


9. Force Majeure or Act of God. The performance of this contract may be altered or canceled by either party due to causes beyond their control.


10. Previews. Although the photographer will strive to produce proofs/preview prints as detailed in the brochure or discussed, there is no guarantee of a specific number of proofs/preview prints being available.


11. Display. The client permits the photographer to display any images from this contract in studios, portfolios, literature, exhibitions, and advertising. The photographer will not use the images for any commercial purpose without the client’s written permission.


12. Cancellation. The client may cancel this contract at any time by providing written notice to the photographer, but any payments made will be forfeited if rescheduling cannot be arranged.


13. Any unpaid sessions will be canceled without notice.


14. Your ordering/viewing appointment will take place approximately 2 weeks after your session. Once orders are placed and full payment has cleared, your order will be processed and ready for collection within 4 weeks. If processing takes longer, you will be notified in writing. Orders will not be shipped; they must be collected from the studio.


15. Limitation of Liability. In the unlikely event of total photographic failure or contract cancellation by either party, whether due to negligence or otherwise, liability will be limited to the total value of the contract. Neither party shall be liable for indirect or consequential losses.


16. Complaints. Any complaints must be raised by the client in writing to the photographer within 28 days of becoming aware of the issue and, in any case, within 28 days of receiving the images.


17. All raw images from your session will be stored for 2 weeks after your final order has been collected. Edited JPEGs will be stored for an additional 6 months, after which they will be deleted. We are not liable for any lost prints or USBs if you attempt to reorder.


18. We maintain a strict no photography policy in our studio or during photography shoots on location.


I have read this booking form and agree to comply with the terms outlined in this photography services agreement. I understand that changes to these terms require written agreement from both parties.
